1. About these terms

These terms apply to use of Munch Measured Meals’ website and purchases of our prepared meals, meal plans and other products. “Munch”, “we” and “us” means [registered legal entity name and legal status], trading as Munch Measured Meals, registration number [confirm registration number and place of registration].

Our operating address is Allandale Exchange, 917 Morkels Close, Halfway House, Midrand, 1685. Contact us on WhatsApp or by telephone at 072 703 1630. Our address for service of legal documents is [confirm service address]. Supplier office bearers: [confirm names]. Industry memberships and applicable codes of conduct: [confirm details or state none].

These terms must be made available before checkout. By placing an order, you agree to the terms presented for that order. Nothing in these terms removes rights you have under the Consumer Protection Act, Electronic Communications and Transactions Act or other applicable South African law. If a provision conflicts with a mandatory legal right, that right prevails.

2. Ordering and accounts

You must be at least 18 or have a parent or guardian place the order. Provide accurate contact, billing and delivery details and use a payment method you are authorised to use. Keep account access details secure and tell us if you suspect unauthorised use.

Review your selected products, quantities, dietary requests, delivery details and total before paying. An automated acknowledgement confirms receipt of your order; acceptance occurs when we confirm that we can fulfil it. If we cannot fulfil an order, we will contact you and refund any amount paid for the unavailable items unless you agree to an alternative.

If a clear listing or pricing error affects your order, we will explain it and give you the choice of proceeding at the correct price or cancelling the affected items for a refund. We will not add an extra charge without your agreement.

3. Meal plans, preferences and availability

Meal plans contain the products and quantities described when you order. A plan described as 7, 14 or 28 days indicates its stated meal allocation; it does not automatically mean a recurring subscription or daily delivery. Delivery arrangements are those shown or agreed for your order.

Dietary preferences can be added in your checkout notes, including requests to avoid particular meats. Requests are subject to availability and our confirmation. A note requesting “no nuts” or another exclusion does not establish that a meal is safe for a severe allergy.

We will contact you before making a material substitution affecting your selected meals, declared allergens, dietary requirements or price. You may accept an alternative or receive a refund for an unavailable item. Products, promotions and availability may change for future orders.

4. Prices, payment and promotions

Prices are in South African rand unless stated otherwise. The total payable, including applicable taxes and delivery charges, must be disclosed before you confirm your purchase. Payment must be received and confirmed before an order is prepared for dispatch.

Payments are processed through the payment methods shown at checkout. Banking or payment-provider processing times can affect confirmation. Do not send card details, banking passwords or one-time PINs to us on WhatsApp.

Discounts and promotions apply according to the conditions and expiry dates displayed with the offer. A promotion does not change an accepted order’s price retrospectively. Recurring billing may be used only if it is expressly offered and you separately agree to its price, frequency and cancellation terms.

5. Delivery and receiving your order

We deliver to the locations supported at checkout or confirmed with you. Our current general guidance is 3–5 business days after payment is received for Gauteng and 4–7 business days for other supported regions. These are estimates; any specific delivery commitment agreed for your order applies.

Give us an accurate address, access instructions and a reachable telephone number. Arrange for yourself or an authorised recipient to receive the order and store it as directed on the labels. Tell us promptly if the delivery address changes; we will confirm whether a change is still possible.

If delivery fails because of incorrect details or an unavailable recipient, we will discuss a suitable next step and any reasonable additional cost before charging it. We will not leave meals unattended unless you authorise an agreed arrangement. Our responsibilities for proper delivery and any mandatory consumer remedies remain applicable.

Traffic, weather, power interruptions and courier disruptions can cause delays. We will communicate material delays and discuss available remedies. Circumstances outside our control do not excuse delivery of unsafe products or remove statutory cancellation, refund or other rights.

6. Storage, shelf life and heating

Refrigerate meals promptly and follow the storage temperature, use-by date and heating instructions on each product’s packaging. Shelf life varies by product, packaging condition and storage. General website statements are not a substitute for the specific label or use-by date.

Do not consume a product if its seal is broken unexpectedly, its container is swollen or leaking, it appears spoiled, or you believe it has been stored unsafely. Stop using the affected product and contact us promptly. Do not return or discard it until we have advised you how to handle it safely, unless keeping it would create a risk.

Once delivered, you are responsible for following the labelled storage and handling instructions. This does not remove our responsibility for defects or unsafe conditions that existed when supplied. Heat meals according to the label and your appliance’s instructions, ensuring they are heated thoroughly.

7. Ingredients, allergens and nutrition

Read the product’s ingredient and allergen information before eating. Recipes and ingredients can change, so check each pack rather than relying on a previous order. Ask us about ingredient or allergen information before ordering if it is unclear.

We cannot promise a meal is free of a particular allergen unless we have expressly confirmed that claim for the relevant product and preparation conditions. If you have a severe allergy, speak to us before purchasing so we can explain whether we can meet your needs. Do not rely on meal-category names as an allergen guarantee. Munch’s meals are not Halaal-certified.

Calories, macros, calculators and meal-plan recommendations provide general information. They are not a diagnosis, medical treatment or a guarantee of weight loss, muscle gain or another health outcome. Actual outcomes vary. Seek advice from an appropriately qualified professional where you have a medical condition or need a medically prescribed diet.

8. Changes and cancellations

Contact us on WhatsApp as soon as possible if you need to change or cancel an order. We will check its fulfilment stage and explain what is possible before agreeing to a change. Any cancellation charge must be lawful, reasonable and explained; we do not impose a blanket forfeiture of all payments.

Food supplied for everyday consumption and products likely to deteriorate rapidly may fall outside the ECTA seven-day cooling-off provision. This does not remove other cancellation rights, rights arising from direct marketing, or remedies for incorrect, defective or unsafe products where the law provides them.

If Munch cancels an order or cannot supply an item, we will refund the affected amount unless you choose an agreed alternative. Changes to your address or meal selection take effect only when we confirm them.

9. Problems, replacements and refunds

If you are unhappy with a meal bought directly from Munch, our published replacement promise offers another meal of your choice at no additional delivery cost. For this voluntary promise, contact 072 703 1630 within 24 hours of receiving your meal with your order number and a brief description. We may ask for a photo to help improve our products and processes.

The 24-hour period applies to that voluntary replacement process. It does not shorten statutory time limits or remove your right to an appropriate remedy for a defect, unsafe product, incorrect order or other breach. A replacement is not your only remedy where the law entitles you to a refund or another remedy.

For food-safety reasons, returned meals cannot be put back into saleable stock. This does not mean that all legal returns or refund rights are excluded. Contact us for safe collection or disposal instructions rather than returning food without arrangements.

Read our Refund & Returns Policy on our Refund & Returns Policy page together with these terms. Any restriction in that policy is subject to mandatory consumer rights; where it conflicts with this express preservation of those rights, the statutory protection applies. Refunds will be arranged through an appropriate payment method within the period required by law.

10. Website use and intellectual property

You may use the website for lawful personal browsing and purchases. Do not interfere with its security, submit fraudulent orders, misuse another person’s account, or copy and commercially exploit our content without permission.

Munch’s branding, photographs, text and other website materials belong to Munch or their respective owners and are protected by applicable intellectual property law. Links to external services are provided for convenience; those services have their own terms and privacy notices.

11. Privacy and responsibility

Our Privacy Policy explains how we handle personal information, including WhatsApp messages, order and delivery details, and optional dietary information. Using the website does not itself constitute consent to every form of processing or electronic marketing.

Each party remains responsible to the extent required by applicable law. Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for gross negligence, fraud, unsafe products or product-related harm where the law imposes it. We do not require you to waive mandatory consumer protections.

12. Complaints, applicable law and updates

For an order complaint, message 072 703 1630 with your order number and what went wrong. We will investigate and work with you towards a fair resolution. You remain free to approach a competent consumer body, regulator, ombud or court; using WhatsApp support first is not a condition for exercising legal rights.

South African law applies, subject to any mandatory protections applicable to you. These terms do not force you into a private dispute process or prevent you from using a court with lawful jurisdiction.

We may update these terms for future orders and show the latest update date. The version accepted for an existing order continues to govern that order unless a lawful change is agreed. If one provision is unenforceable, the remaining provisions continue to apply to the extent lawful.
